These Terms of Service (the "Terms") are a binding legal agreement between you and Monitor My Air ("Monitor My Air," "we," "us," or "our"), the operator of the website at monitormyairlibrary.com and its member application at app.monitormyairlibrary.com (together, the "Service"). They govern your access to and use of the Service, including the paid membership known as the Monitor My Air Library (the "Library"), one-time consultations, our free expert-matching directory, higher-tier advisory offerings, and any content, features, or communications we provide.
Please read these Terms carefully. They include important provisions that affect your legal rights, including a disclaimer that our Service is educational and not professional advice, a limitation of our liability, an assumption of risk, an agreement to resolve most disputes informally and then through binding individual arbitration, and a waiver of class actions. By creating an account, subscribing, making a payment, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Monitor My Air operates from Virginia Beach, Virginia, USA, and offers its services online. The same owner also operates the related sites mold.cx (www.mold.cx) and monitormyair.com (www.monitormyair.com). These Terms cover only monitormyairlibrary.com and its member application at app.monitormyairlibrary.com. Other properties may have their own separate terms.
We communicate with members and visitors by email only; we do not publish a physical mailing address. You can reach us using the addresses listed in the Contact section at the end of these Terms.
You must be at least 18 years old and able to form a binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements, that the information you provide is accurate, and that your use complies with all laws that apply to you. The Service is intended for use in the United States. If you access it from elsewhere, you do so on your own initiative and are responsible for compliance with local laws.
This is the single most important thing to understand about Monitor My Air. Everything we provide is general educational information and coordination to help you understand indoor air, moisture, mold, and related topics, and to help you find qualified people to help you.
Monitor My Air is not medical advice, and it is not a medical, clinical, diagnostic, or healthcare service. It is not legal advice, engineering advice, industrial-hygiene advice, home-inspection advice, or remediation advice. Our content, tools, consultations, directory, and communications are not a substitute for the judgment of a licensed physician, industrial hygienist, inspector, engineer, contractor, attorney, or other qualified professional who can evaluate your specific situation in person.
Using the Service does not create a doctor-patient relationship, a professional-client relationship, a fiduciary relationship, or any other special or advisory relationship between you and Monitor My Air. You should always seek the advice of appropriately licensed and qualified professionals before making decisions about your health, your home, your air quality, testing, remediation, construction, or any related matter. Never disregard, delay, or avoid seeking professional advice because of something you read, heard, or received through the Service. If you believe you have a medical emergency, call your local emergency number or seek immediate care from a qualified provider.
We do not promise results. Monitor My Air makes no guarantee, representation, or warranty of any kind that:
Indoor environments and human health are complex and highly individual. Outcomes depend on many factors outside our knowledge and control. Any decision you make based on the Service is your own.
The free expert-matching directory and any expert, inspector, laboratory, industrial hygienist, contractor, remediator, or other professional you find through, are matched with, or are referred to by the Service are independent third parties. They are not employees, partners, agents, joint venturers, or representatives of Monitor My Air, and we do not control them.
When you engage any such professional, you contract with them directly and on your own behalf. Monitor My Air does not perform, supervise, direct, inspect, verify, warrant, endorse, or accept responsibility for their work, results, pricing, timeliness, insurance, licensing, credentials, background, or conduct. Any listing, match, ranking, or description in the directory is provided for your convenience and is not a recommendation, certification, or guarantee. You are solely responsible for evaluating, selecting, vetting, negotiating with, supervising, and paying any professional you choose, and for confirming their qualifications, licensing, and insurance. Any dispute you have with a third-party professional is between you and that professional, and Monitor My Air is not a party to it.
We may offer one-time consultations and higher-tier advisory engagements. These are educational and coordination services provided subject to Section 3 above. During a consultation or advisory session we may share general information, help you organize your questions, explain concepts in plain language, and help you understand your options and how to find qualified help. We do not diagnose medical conditions, do not perform inspections or testing, do not provide licensed professional opinions, and do not direct the work of any third party. Scheduling, scope, and fees for consultations and advisory offerings are described at the point of purchase. Missed appointments and rescheduling may be subject to the policies presented when you book.
The Library is a paid membership offered on a recurring subscription basis, typically at approximately $29 per month or approximately $249 per year, in each case as presented to you at checkout and subject to applicable taxes. Current prices, plan features, and billing intervals are shown at the point of purchase and control over any figure stated here.
Automatic renewal. Paid memberships renew automatically. When you subscribe, you authorize Monitor My Air and its payment processor to charge your payment method on a recurring basis, at the then-current price for your plan, at the start of each billing period (each month or each year, depending on your plan), until you cancel. Renewal happens without further action by you. By subscribing, you consent to these recurring charges.
Cancellation. You may cancel your membership at any time through your account settings in the app or by contacting us at the email addresses below. Cancellation stops future renewals. When you cancel, your membership generally remains active through the end of the billing period you have already paid for, and it will not renew after that. Except where required by law or expressly stated otherwise at purchase, payments already made are non-refundable, and we do not provide prorated refunds for partial billing periods. If a specific refund or trial policy is presented to you at checkout, that policy applies to your purchase.
Price changes. We may change membership prices and plan features. If we change the recurring price that applies to you, we will give you notice by email or in the app before the change takes effect for your next renewal. If you do not agree to a price change, you may cancel before it takes effect; continuing your membership after the change takes effect means you accept the new price.
Billing accuracy and failed payments. You agree to keep your billing information current and accurate. If a charge is declined or fails, we may retry the charge, suspend or downgrade your access, or cancel your membership. You remain responsible for amounts owed for access already provided.
Payments are processed by a third-party payment processor (currently Stripe). By paying, you also agree to the processor's applicable terms. We do not store your full payment card number; that information is handled by the processor. You represent that you are authorized to use the payment method you provide. You are responsible for any taxes associated with your purchase other than taxes based on our net income. If you believe you have been charged in error, contact us before initiating a chargeback so we can try to resolve it.
You agree not to, and not to attempt to, do any of the following:
The Service and its contents, including the Library articles, guides, videos, courses, graphics, text, layouts, designs, logos, trademarks, software, and the selection and arrangement of all of it, are owned by Monitor My Air or its licensors and are protected by copyright, trademark, and other laws. "Monitor My Air" and the "Monitor My Air Library" names and logos are marks of the business and may not be used without permission.
Subject to these Terms and your payment of any applicable fees, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service and to view Library content for your own personal, non-commercial use. This license does not permit you to download (except where a download feature is expressly provided), copy, redistribute, publicly display, resell, or otherwise exploit the content, and it ends when your membership ends or these Terms terminate. All rights not expressly granted are reserved.
The Service may let you post comments, questions, reviews, and other content ("User Content"). You retain ownership of your User Content, but by posting it you grant Monitor My Air a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, adapt, publish, display, and distribute your User Content in connection with operating, promoting, and improving the Service. You represent that you own or have the necessary rights to your User Content and that it does not violate any law or any third party's rights.
You are solely responsible for your User Content. Do not post anything that is unlawful, infringing, defamatory, harassing, hateful, threatening, deceptive, invasive of privacy, or that offers medical, legal, or other professional advice as if you were a licensed professional. We may, but are not obligated to, monitor, moderate, edit, refuse, or remove any User Content, and we may suspend or terminate accounts, at our discretion and without liability, including to protect the community or comply with law. User Content reflects the views of the people who post it, not Monitor My Air, and we do not endorse or verify it.
The Service may contain links to, or integrations with, third-party websites, tools, products, and services, including our payment processor and the independent professionals in the directory. We provide these for convenience and do not control, endorse, or assume responsibility for third-party content, products, services, privacy practices, or conduct. Your dealings with third parties are solely between you and them, and are governed by their terms.
You understand and voluntarily accept that using the Service, acting on educational information, engaging independent professionals, testing or remediating an indoor environment, and making decisions about your home and health all involve inherent risks. To the fullest extent permitted by law, you knowingly and freely assume all such risks arising from or related to your use of the Service and any actions you take based on it, and you agree that Monitor My Air is not responsible for the choices you make or the results you experience.
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by law, Monitor My Air and its owner, and their affiliates, disclaim all warranties of any kind, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement, and any warranties arising from course of dealing or usage of trade. We do not warrant that the Service will be uninterrupted, secure, timely, error-free, or free of harmful components, that defects will be corrected, or that any information provided is accurate, reliable, complete, or current. No advice or information, whether oral or written, obtained from the Service creates any warranty not expressly stated in these Terms. Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.
To the fullest extent permitted by law, Monitor My Air and its owner, and their affiliates, service providers, and licensors, will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, health outcomes, or business, arising out of or related to these Terms or your use of, or inability to use, the Service, or any acts or omissions of any independent third-party professional, whether based on warranty, contract, tort (including negligence), strict liability, or any other legal theory, and whether or not we have been advised of the possibility of such damages.
To the fullest extent permitted by law, the total aggregate liability of Monitor My Air and its owner for all claims arising out of or related to these Terms or the Service will not exceed the greater of (a) the total amount you actually paid to Monitor My Air for the Service during the twelve (12) months immediately before the event giving rise to the claim, or (b) one hundred U.S. dollars ($100) if you have not paid us anything (for example, if you only used the free directory).
These limitations are an essential part of the agreement between you and us and apply even if a limited remedy fails of its essential purpose. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you; in that case, our liability is limited to the smallest extent permitted by law.
You agree to defend, indemnify, and hold harmless Monitor My Air and its owner, and their affiliates, and their respective officers, contractors, and agents, from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms or of any law or third-party right; (d) your engagement of, dealings with, or disputes with any independent third-party professional; or (e) any decision or action you take regarding your health, home, or environment. We may assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense.
Please read this section carefully. It affects how disputes between you and Monitor My Air are resolved and limits how you can seek relief.
Before starting any arbitration or other formal proceeding, you and Monitor My Air agree to try in good faith to resolve any dispute informally for at least sixty (60) days. To begin, send a written notice of dispute to us at the email addresses in the Contact section describing the dispute and the relief you seek; we will send any notice to you at the email associated with your account. If we cannot resolve the dispute within sixty (60) days after the notice is received, either party may begin arbitration as described below. This informal-resolution requirement is a condition that must be satisfied before starting arbitration. Any statute of limitations will be tolled during the informal-resolution period.
Except for the exceptions below, any dispute, claim, or controversy arising out of or relating to these Terms or the Service that is not resolved informally will be resolved by final and binding individual arbitration, and not in court, except that either party may bring qualifying claims in small-claims court. The arbitration will be administered by a recognized, neutral arbitration provider under its consumer arbitration rules then in effect, before a single arbitrator. The arbitration will take place in or near Virginia Beach, Virginia, or by video or telephone where the rules permit, and the arbitrator's award may be entered as a judgment in any court of competent jurisdiction. The arbitrator has exclusive authority to resolve threshold issues about the scope, enforceability, and interpretation of this arbitration agreement, except that a court decides the enforceability of the class-action waiver below. This arbitration agreement is governed by the Federal Arbitration Act.
Exceptions. This arbitration agreement does not require arbitration of: (a) individual claims that qualify for small-claims court; or (b) requests for temporary injunctive relief to stop actual or threatened infringement, misappropriation, or violation of intellectual-property or confidentiality rights, which either party may bring in a court as described in the Governing Law section.
You and Monitor My Air agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding. You and Monitor My Air also waive any right to a jury trial. If this class-action waiver is found unenforceable as to a particular claim, that claim (and only that claim) will be severed and may proceed in court, while all other claims remain in arbitration.
You may opt out of the arbitration agreement and class-action waiver in Sections 18.2 and 18.3 by sending us written notice within thirty (30) days after you first accept these Terms. Send your opt-out notice to the email addresses in the Contact section, and include your name and the email associated with your account, along with a clear statement that you want to opt out of arbitration. Opting out will not affect any other part of these Terms, and it will not affect any arbitration agreement you may have with us from a prior version of these Terms. If you opt out, disputes will be resolved in the courts identified in the Governing Law section.
These Terms and any dispute arising out of or related to them or the Service are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws rules, and, where applicable to arbitration, by the Federal Arbitration Act. Subject to the arbitration agreement above, you and Monitor My Air agree that any claim not subject to arbitration will be brought exclusively in the state or federal courts located in or serving Virginia Beach, Virginia, and you consent to the personal jurisdiction and venue of those courts.
We may modify, suspend, or discontinue any part of the Service, including features, content, plans, and pricing, at any time. We may also update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice by email or in the app. Changes are effective when posted unless we say otherwise. Your continued use of the Service after changes take effect means you accept the updated Terms. If you do not agree to the changes, stop using the Service and cancel any paid membership.
You may stop using the Service and cancel your membership at any time as described above. We may suspend or terminate your access, membership, or account at any time, with or without notice, if you violate these Terms, if we reasonably believe your use poses a risk to the Service or others, or if we discontinue the Service. On termination, your license to use the Service ends and you must stop using it. Sections that by their nature should survive termination, including those on intellectual property, disclaimers, assumption of risk, limitation of liability, indemnification, dispute resolution, arbitration, governing law, and miscellaneous provisions, will survive.
