This Refund & Cancellation Policy explains how billing, cancellations, and refunds work for the products and services offered by Monitor My Air. It applies to monitormyairlibrary.com and the member application at app.monitormyairlibrary.com (together, the "Service"). Please read it carefully. By purchasing or using the Service, you agree to this policy, along with our Terms of Service and Privacy Policy.
In this policy, "Monitor My Air," "we," "us," and "our" mean Monitor My Air, the operator of the Service, based in Virginia Beach, Virginia, USA. "You" means the person or entity purchasing or using the Service. The gated membership product is referred to as the "Monitor My Air Library" or the "Library."
Monitor My Air provides general educational information and coordination. It is not medical advice, not a medical or clinical service, not a diagnosis, and not a substitute for a licensed physician, industrial hygienist, home inspector, environmental professional, remediation contractor, attorney, or any other licensed professional. Using the Service does not create a doctor-patient relationship, a professional-client relationship, or any similar relationship. You should always consult qualified, licensed professionals about your specific situation before making decisions about your health or your property.
We make no guarantee of any health outcome, test result, remediation result, or that any condition will be found, fixed, prevented, or improved. Because our products deliver educational information and access rather than a promised result, the value you receive is the access itself, not any particular outcome. This context matters for how refunds are handled below.
The Service offers several distinct products, and different rules apply to each:
Payments are processed by a third-party payment processor (Stripe). We do not store full payment card numbers on our own systems. When you buy a membership or other paid product, you authorize the processor to charge your selected payment method for the amount shown at checkout, including applicable taxes, and, for subscriptions, to charge that method automatically on each renewal until you cancel. Your use of the processor is also subject to the processor's own terms and privacy practices.
Library membership is a recurring subscription. When you subscribe, you agree that:
You can cancel anytime. Cancelling stops future renewals so that you are not charged again after the current period ends. To cancel, use the account or billing settings inside the member application at app.monitormyairlibrary.com, or email us at one of the support addresses at the bottom of this page and ask us to cancel for you.
When you cancel:
The Library delivers digital, educational access that is available immediately upon purchase. For that reason, membership fees are generally non-refundable once your membership has begun or once you have accessed, viewed, downloaded, or otherwise used any gated content or member feature during the billing period in question. This includes both monthly and annual plans, and it includes renewal charges.

We want members to feel treated fairly. Even though membership fees are generally non-refundable, we may, at our sole discretion and as a one-time courtesy, offer a full refund, a partial or pro-rated refund, or an account credit in circumstances such as:
Any such accommodation is offered case by case, is not a waiver of this policy, and does not entitle you or anyone else to the same treatment in the future. We reserve the right to grant or decline any goodwill request. Where required by applicable law, nothing in this policy limits refund or cancellation rights that the law grants you and that cannot be waived.
Consultations are booked for a specific time and reserve a block of our availability. The following applies unless your booking confirmation states otherwise:
If we need to cancel or reschedule a consultation for reasons on our side, we will offer you a new time or a full refund of that consultation's fee.
Advisory engagements may have their own written terms covering scope, fees, scheduling, and cancellation, which are provided before purchase. Where such written terms exist, they control for that engagement. Where they are silent, the consultation rules above apply by analogy: fees for time that has been reserved or work that has been delivered are generally non-refundable, and completed advisory sessions are non-refundable.
The expert-matching directory is provided free of charge. There is nothing to refund. Experts you find through the directory are independent third parties, and any payments you make to them are between you and them, governed by their own terms and refund practices. See "Independent third parties" below.

We aim to review refund requests promptly. Approved refunds are issued to the original payment method through our payment processor. The time it takes for a refund to appear on your statement depends on your bank or card issuer and is outside our control.
If you believe a charge is wrong, please contact us first so we can look into it and try to resolve it directly. Filing a chargeback or payment dispute with your bank or card issuer before contacting us can delay resolution and may lead to the suspension or termination of your account while the dispute is investigated. We reserve the right to respond to disputes with evidence of your purchase, your acceptance of this policy, and your access to or use of the Service. Filing a chargeback for a charge that reflects access you actually used may be treated as a breach of these terms. Nothing here limits any legal right you have to dispute a genuinely unauthorized charge.
We may change, add, or discontinue features, content, or products, and we may change prices, plans, or the structure of our offerings. If we change the recurring price of a plan you are subscribed to, we will give you notice before the change takes effect for your next renewal, and your continued membership after the change means you accept the new price. If you do not accept a price change, you may cancel before your next renewal. Price changes are not retroactive to periods already paid.
The Service is intended for adults. By purchasing or using it, you confirm that you are at least 18 years old and able to enter into a binding agreement. If you are using the Service on behalf of an organization, you confirm you are authorized to bind that organization.
You agree to use the Service lawfully and not to misuse it. Among other things, you agree not to:
Fees paid for a membership or product that is suspended or terminated because you violated this policy or our Terms of Service are not refundable.
All Library content, including text, guides, articles, checklists, tools, graphics, and other materials we create, is owned by Monitor My Air or its licensors and is protected by intellectual-property laws. Your membership grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the content for your own personal, non-commercial purposes while your membership is active. You may not copy, redistribute, resell, republish, sublicense, or create derivative works from the content, and you may not scrape or bulk-download it, except as expressly allowed in writing by us. This license ends when your membership ends.
You are responsible for keeping your login credentials confidential and for all activity under your account. Please notify us promptly of any unauthorized use. We are not responsible for losses arising from your failure to safeguard your credentials, and unauthorized use by someone you allowed to access your account is not, by itself, a basis for a refund.
If the Service includes community or member-submitted content, you keep ownership of what you post, but you grant Monitor My Air a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute your submissions within and in connection with the Service. You are responsible for what you post, and you confirm you have the rights to post it. We may moderate, edit, refuse, or remove content and may suspend or terminate accounts that violate our rules, in our discretion, without any obligation to refund.
Inspectors, laboratories, contractors, remediators, physicians, and other experts that you find through the directory or that are referenced anywhere in the Service are independent third parties. They are not employees, agents, partners, or representatives of Monitor My Air. We do not perform, supervise, direct, control, endorse, warrant, or accept any liability for their work, availability, pricing, licensing, qualifications, or conduct. You contract with them directly, on their own terms, and any payments, disputes, guarantees, or refunds relating to their services are strictly between you and them. Monitor My Air is not a party to those arrangements and does not refund money you paid to a third party.
The Service may link to third-party websites, tools, or resources. We provide these for convenience and do not control or endorse them. We are not responsible for their content, availability, practices, purchases made through them, or any refunds they owe.
You understand that decisions about your health, your home, and your environment carry inherent risk, and that our educational information is a starting point, not a professional evaluation of your specific situation. To the fullest extent permitted by law, you voluntarily assume all risk arising from your use of the Service and from any action or inaction you take based on it, and you agree to seek out qualified licensed professionals for your specific circumstances.
The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement, and any warranty that the Service will be uninterrupted, error-free, secure, complete, current, or that it will produce any particular result. Some jurisdictions do not allow certain warranty exclusions, so some of these may not apply to you.
To the fullest extent permitted by law, Monitor My Air and its owners, operators, officers, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to your use of, or inability to use, the Service, even if we have been advised of the possibility of such damages.
To the fullest extent permitted by law, our total aggregate liability for all claims arising out of or relating to the Service is limited to the greater of (a) the total amount you actually paid to Monitor My Air for the Service in the twelve (12) months immediately before the event giving rise to the claim, or (b) one hundred U.S. dollars ($100) if you paid nothing. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
You agree to defend, indemnify, and hold harmless Monitor My Air and its owners, operators, officers, employees, contractors, and agents from and against any claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Service, your violation of this policy or our Terms of Service, your violation of any law or the rights of any third party, your content, or your dealings with any independent third party found through or referenced in the Service.
You may stop using the Service and cancel your membership at any time. We may suspend or terminate your access, in whole or in part, if you breach this policy or our Terms of Service, if we suspect fraud or misuse, if required by law, or if we discontinue the Service. If we terminate your access without cause, we will refund any prepaid, unused portion of a subscription on a pro-rated basis; if we terminate your access because of your breach or misuse, fees are not refundable. Sections that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution, will survive.
This policy and any dispute arising out of or relating to it or to the Service are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws rules. Subject to the dispute-resolution terms below, the exclusive venue for any permitted court action is the state or federal courts located in or serving Virginia Beach, Virginia, and you consent to the personal jurisdiction of those courts.
Before starting any formal proceeding, you agree to first try to resolve the dispute informally by contacting us at one of the support addresses below and giving us a written description of the problem and the resolution you want. You and Monitor My Air agree to negotiate in good faith for at least thirty (30) days from that notice. Many issues, including billing questions, are resolved quickly this way. This step is a required precondition to arbitration or litigation.
Please read this section carefully; it affects how disputes are resolved. If informal resolution does not settle a dispute within thirty (30) days, then, to the fullest extent permitted by law, you and Monitor My Air agree that any dispute, claim, or controversy arising out of or relating to this policy or the Service will be resolved by final and binding arbitration on an individual basis, rather than in court, except that either party may bring an individual claim in small-claims court if it qualifies. The arbitration will be administered by a recognized arbitration provider under its consumer rules, and will take place in or be seated in Virginia Beach, Virginia, or be conducted remotely where allowed.
You and Monitor My Air agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated, or representative action. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding. If this class-action waiver is found unenforceable as to a particular claim, that claim (and only that claim) will proceed in court, while the rest of this section remains in effect.
Opt-out. You may opt out of this arbitration and class-action-waiver section by emailing us at support@monitormyairlibrary.com within thirty (30) days of first accepting this policy, with your name, the email on your account, and a clear statement that you opt out of arbitration. Opting out will not affect any other part of this policy or your use of the Service.
We may update this policy from time to time. When we do, we will change the "Last updated" date above and post the revised version. Material changes may also be communicated by email or in the app. Changes apply going forward; they do not retroactively change the treatment of charges made before the change. Your continued use of the Service after a change takes effect means you accept the updated policy.
If any part of this policy is found unenforceable, that part will be limited or removed to the minimum extent necessary, and the rest will stay in full force. Our failure to enforce any provision is not a waiver of it. This policy works together with our Terms of Service and Privacy Policy; if there is a direct conflict about refunds or cancellations specifically, this policy controls for those topics.
