Our business model includes a paid Library membership (approximately $29 per month or $249 per year, billed as a recurring, automatically renewing subscription), one-time consultations, a free expert-matching directory, and higher-tier advisory. Prices are stated at the point of purchase and may change as described below. Payments are processed by a third-party payment processor (Stripe); your use of payment features is subject to that processor's terms and privacy policy. We do not store your full card number. Monitor My Air is not responsible for the acts or omissions of the payment processor. Cancellations, renewals, and refunds are governed by our Terms of Service and Refund & Cancellation Policy.
We may add, change, suspend, limit, or discontinue any part of the Service, and we may change our pricing, plans, or features, at any time. For recurring subscriptions, price changes will apply to future billing periods as described in our Terms of Service, and your continued use or renewal after a change takes effect constitutes acceptance of the change. We may also update this Disclaimer from time to time; the "Last updated" date above reflects the most recent version, and your continued use of the Service after changes are posted means you accept the updated Disclaimer.
You may stop using the Service and close your account at any time. We may suspend or terminate your access to all or part of the Service at any time, with or without cause and with or without notice, including for any breach of this Disclaimer or the Terms of Service. Upon termination, your license to access the content ends, but the sections of this Disclaimer that by their nature should survive, including disclaimers, assumption of risk, limitation of liability, indemnification, intellectual-property limits, governing law, and dispute resolution, will continue to apply.

This informal-resolution step is a required condition before either party may commence arbitration or litigation, except that either party may seek urgent injunctive relief to protect intellectual property or security.

Except for the limited exceptions below, if informal resolution does not resolve the dispute, you and Monitor My Air agree that any dispute arising out of or relating to this Disclaimer or the Service will be resolved by final and binding individual arbitration, rather than in court, before a single neutral arbitrator. The arbitration will be administered by a reputable, nationally recognized arbitration provider under its consumer arbitration rules then in effect, and it will be seated in Virginia Beach, Virginia, or conducted remotely as the rules allow. The arbitrator will apply the governing law stated above, and judgment on the award may be entered in any court with jurisdiction.
Class-action and jury waiver: to the fullest extent permitted by law, you and Monitor My Air agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding. You and Monitor My Air waive any right to a jury trial.
Exceptions: either party may bring an individual claim in a small-claims court if it qualifies, and either party may seek injunctive or equitable relief in court to protect intellectual-property rights or the security of the Service.
30-day opt-out: you may opt out of this arbitration and class-action-waiver section by sending written notice to support@monitormyairlibrary.com within thirty (30) days of first accepting this Disclaimer, stating your name and a clear statement that you wish to opt out of arbitration. If you opt out, the governing-law and venue section above applies to your disputes. Opting out does not affect any other part of this Disclaimer.
If any part of this arbitration section is found unenforceable, the remainder will remain in effect, except that if the class-action waiver is found unenforceable as to a particular claim, that claim will proceed in court rather than in arbitration.
If any provision of this Disclaimer is held invalid or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision is not a waiver of that right or provision.
