This Privacy Policy explains how Monitor My Air ("Monitor My Air," "we," "us," or "our") collects, uses, shares, and protects information in connection with the Monitor My Air Library and the website and application operated at monitormyairlibrary.com and app.monitormyairlibrary.com (together, the "Service"). We operate from Virginia Beach, Virginia, USA.
The same owner also operates the related sites mold.cx (www.mold.cx) and monitormyair.com (www.monitormyair.com). Those sites may carry their own notices. This Policy applies specifically to monitormyairlibrary.com and its application at app.monitormyairlibrary.com. By using the Service, you agree to the practices described here. If you do not agree, please do not use the Service.
Monitor My Air provides general educational information and coordination. It is not medical advice, not a medical or clinical service, not a diagnosis, and not a substitute for a licensed physician, industrial hygienist, inspector, contractor, or other qualified professional. Using the Service does not create a doctor-patient or any other professional-client relationship. We do not guarantee any health outcome, test result, or remediation result. Please consult qualified, licensed professionals about your specific situation. This matters for privacy too: any health-related information you choose to share with us is voluntary, and we do not treat it as protected health information under HIPAA (see "Health information you volunteer," below).
We collect the following categories of information, depending on how you use the Service.
Paid Library memberships (approximately $29 per month or $249 per year, recurring and auto-renewing), one-time consultations, and higher-tier advisory are billed through our third-party payment processor, Stripe. When you pay, Stripe collects and processes your card or payment details directly. We do not store full card numbers. We receive only limited billing information from Stripe, such as a payment token or reference, the card brand and last four digits, the billing name, the expiration month and year, and the status of your subscription or payment. Stripe's handling of your data is governed by Stripe's own privacy policy.
We use the information we collect to:
For visitors in jurisdictions that require a legal basis to process personal data (such as under the GDPR), we rely on: performance of a contract (to provide the Service you request), your consent (for optional communications and certain cookies), our legitimate interests (to secure, operate, and improve the Service), and compliance with legal obligations. Where you have volunteered health-related details, we rely on your consent, which you may withdraw at any time.
We do not sell your personal information for money. We share information only as described here.
When you use the expert-matching directory or request a referral, we share the details reasonably necessary to make the connection, such as your name, contact information, general location, and the situation you described, with the relevant independent expert. These inspectors, laboratories, contractors, and other experts are independent third parties, not employees or agents of Monitor My Air. Once connected, you contract with them directly, and their handling of your information is governed by their own terms and privacy practices. We do not perform, supervise, warrant, or accept liability for their work, pricing, licensing, or conduct.
We share information with vendors who process it on our behalf and under our instructions, only to run the Service, including:
We may disclose information if we believe in good faith that it is required to comply with a law, regulation, legal process, or governmental request; to enforce our terms; to detect, prevent, or address fraud, security, or technical issues; or to protect the rights, property, or safety of Monitor My Air, our users, or the public.
If Monitor My Air is involved in a merger, acquisition, financing, or sale of assets, your information may be transferred as part of that transaction, subject to this Policy.
Content you post in community areas is visible to other members and, depending on the feature, may be visible more broadly. Please do not post information you would not want others to see. You keep ownership of what you post, and by posting you grant Monitor My Air a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute that content within the Service for operating and promoting the community. We may moderate, remove, or restrict content and accounts at our discretion.
We use cookies and similar technologies that are strictly necessary to run the Service (for example, to keep you signed in and to secure the Service) and a limited set that help us understand aggregate usage. Analytics are provided by Cloudflare and are designed to be privacy-conscious; where possible, usage is measured in aggregate rather than by tracking you across other sites. You can control cookies through your browser settings, though disabling some cookies may affect how the Service works. We do not use your data to build cross-site advertising profiles, and we do not run third-party advertising trackers.
We keep personal information for as long as your account is active and for as long as needed to provide the Service, then for a reasonable period afterward to comply with legal, tax, accounting, and record-keeping obligations, to resolve disputes, and to enforce our agreements. Billing records are retained as required by law and by Stripe. Community posts may remain visible after your account closes unless you remove them or ask us to. When information is no longer needed, we delete or de-identify it.
Depending on where you live, you may have some or all of the following rights regarding your personal information:
These rights reflect protections such as the California Consumer Privacy Act (CCPA/CPRA) and the EU and UK General Data Protection Regulation (GDPR). Under the CCPA, you also have the right not to receive discriminatory treatment for exercising your rights; because we do not sell or "share" personal information for cross-context behavioral advertising, there is no such activity to opt out of. To exercise any right, email us using the contact details below. We will verify your request and respond within the timeframe required by applicable law. You may authorize an agent to act on your behalf where the law allows, and you may appeal a decision by replying to our response.
We operate in the United States, and our providers may process and store information in the United States and other countries. If you access the Service from outside the United States, you understand that your information may be transferred to, stored in, and processed in the United States, where privacy laws may differ from those in your location. Where required, we rely on appropriate safeguards for such transfers.
We take reasonable technical and organizational measures to protect your information, including encryption in transit, hashed passwords, access controls, and reputable infrastructure providers. No method of transmission or storage is perfectly secure, however, and we cannot guarantee absolute security. You are responsible for keeping your login credentials confidential and for activity under your account. If you believe your account has been compromised, contact us right away.
The Service is intended only for adults 18 years of age or older. It is not directed to children, and we do not knowingly collect personal information from anyone under 18. If you are under 18, please do not use the Service or provide any information. If we learn that we have collected information from someone under 18, we will delete it. If you believe a minor has provided us information, contact us and we will act promptly.
The Service may link to third-party websites, tools, or the sites of independent experts. We do not control and are not responsible for the privacy practices or content of those third parties. Their use of your information is governed by their own policies, and we encourage you to review them.
To keep expectations clear: Monitor My Air makes no guarantee of any health outcome, test result, remediation result, or that any condition will be found, fixed, or prevented. The inspectors, labs, contractors, and other experts you may find through the directory are independent third parties. We do not perform, supervise, warrant, or accept liability for their services, and you engage them at your own discretion and risk. The Service is provided on an "as is" and "as available" basis. Fuller terms, including assumption of risk, limitation of liability, and indemnification, appear in our Terms of Service.
We may update this Policy from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you through the Service or by email. Your continued use of the Service after an update means you accept the revised Policy.
This Policy and any dispute relating to it or to your privacy are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws rules. The exclusive venue for any matter not subject to arbitration is the state or federal courts located in Virginia Beach, Virginia, and you consent to their jurisdiction.
Before starting any formal proceeding, you agree to first contact us and give us a genuine opportunity to resolve the matter informally. Send a written description of the dispute and your contact information to the support email below. Both parties agree to negotiate in good faith for at least 60 days from the date of that notice. This step is a required precondition to arbitration or litigation.
If the dispute is not resolved informally, you and Monitor My Air agree that any dispute, claim, or controversy arising out of or relating to this Policy or the Service will be resolved by binding individual arbitration, administered under the rules of a recognized arbitration provider, seated in or conducted remotely for Virginia Beach, Virginia, rather than in court, except that either party may bring an individual claim in small-claims court. You and Monitor My Air waive any right to a jury trial and agree that claims may be brought only in an individual capacity, and not as a plaintiff or class member in any class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims or preside over any form of class proceeding.
You may opt out of the arbitration and class-action-waiver provisions above by emailing us at the address below within 30 days of first accepting this Policy or first using the Service, stating clearly that you opt out of arbitration and including your name and account email. Opting out will not affect any other part of this Policy or your use of the Service.
The data controller responsible for your information is Monitor My Air, operating from Virginia Beach, Virginia, USA. We do not publish a physical mailing address; the best and fastest way to reach us about privacy is by email.
Please use either address for privacy questions, to exercise your rights, to withdraw consent, to report a concern, or to send the notices described in this Policy. We will respond as promptly as reasonably possible and within any timeframe required by applicable law.
